Is Playing Poker at Home Illegal?

gambling in marylandThe answer, in Maryland, at present, is yes.  However, that can be changing soon.

The Maryland Senate has a bill before it known as Senate Bill 428 which would make it expressly legal for someone to host and play in home poker games without fear of prosecution from law enforcement.

Most people are surprised to learn that the Maryland law, at best, is ambiguous about the legality of so-called “home games.”  The new Senate Bill does not, in any way, legalize online gambling, and precludes the person who is running the game from benefiting financially from the game or receiving any benefits from the game.

Although the present law indicating that home games are illegal is rarely, if ever, enforced, it is time for Maryland to recognize that social events such as home card games should not be illegal.
