An upstate New York woman was acquitted on a DUI charge on what appears to be one of the most novel defenses of all time..
At the time of her arrest, her blood alcohol content (BAC) was reportedly tested at four times greater than the legal limit. However, her attorney was able to provide that his client has a rare metabolic condition that is termed “Auto-Brewery Syndrome”. Apparently, her body automatically converts ordinary food into alcohol, which enters her bloodstream resulting in an extremely high BAC level.
As a caution, don’t plan to rely on this defense in the unfortunate circumstance of your being arrested for DUI. You will need substantive medical testimony to support such a claim.
