Fair Rights for the Disabled

PASSAGE OF THE SPECIAL NEEDS TRUST FAIRNESS ACT: Both the U.S. House and Senate have passed a major health care package that includes the Special Needs Trust (SNT) Fairness Act. Once the President signs the legislation (which he is expected to do), this Act would allow individuals with disabilities, who have capacity, to set up their own d(4)(a) special needs trust. This ends the presumption in the United States law that individuals with disabilities lack the mental capacity to handle their own affairs. This will make it infinitely easier for our clients with disabilities to set up these trusts without having to petition the court or involve a parent or grandparent in setting up their trusts.
